A breach of condition notice is used when a planning condition attached to a planning permission has not been complied with. For example, this might apply if a business is required to close at a certain time but continues operating later.
The notice must give a minimum of 28 days for compliance. There is no right of appeal, which means it can take effect more quickly than an enforcement notice. Only the individual or organisation the notice is served on can be prosecuted if they fail to comply.
If a property changes ownership and the conditions continue to be breached, the local planning authority must serve a new notice on the new owner or alternatively consider issuing an enforcement notice.
