What can local residents say about your application?

People objecting to a planning application can only comment on ‘material considerations’ – this means things that are proper planning considerations such as how your proposal fits with planning policy, amongst other matters.

What are NOT material considerations?

Sometimes in Gypsy and Traveller cases people make points that are not material considerations. These should not be taken into account by the LPA. This might include the following:

  • Devaluation of property
  • Loss of a private view
  • Fear of crime

If someone says something racist, then the LPA should return this to them and not publish it on their website. You should contact the LPA if you see anything published that is racist and ask them to remove it. The case officer will be the best point of contact for this.
